    Contract covering a television

    Does a contract to transfer ownership of a new large screen television have to be in writing to be legal? I agreed orally with our neighbor and now he says the agreement is not valid.

    I wish to inform you that agreement involves offer and acceptance. Hence your agreement may be oral or writing and both may be regarded as valid. In case of oral agreement burden may be upon you to show terms of agreement. You may thus enforce your agreement regarding television.

      The promise of a gift is almost invariably unenforceable.

      So you have nowhere to go with this unless you agreed to pay something or do something in exchange for the TV and he reneged when you attempted to pay or do.

      Next time somebody says they want to give you something, pick it up and take it with you. Say thanks on the way out.

          It is not compulsory for a contract be in writing, but if it is in writing it can be easily enforceable in a court of law. If you have witnesses to your oral agreement you can contest the case. It is good to consult a lawyer in this matter.

            An oral agreement is enforceable if

            1 - It has the elements of a contract: offer, acceptance, consideration, intention to be legally bound, etc.

            2 - If the terms can be proven.

            The offer of a TV doesn't appear to rise to the level of a contract but the OP hasn't come back to address the points I made earlier.

              It sounds like he was just doing you a favor and changed his mind for some reason.
              Buy the TV on Amazon, it wont cost much more.
