Default UAE Collection Agencies

Hi,

I am a Sri Lakan, worked in Saudi Arabia 7 years ago, terminated by the company under article 73 of Saudi Labour law and deported me immediately.

I had used 2 credit cards with the credit limit of SR7,000/- each and a salary account at SABB. I think I had around SR5,000/- debt on my both card. I paid credit shield every month.

After long years, I received call from a collection agency in UAE that he trace my contact no through Facebook. He asked me to pay about SR25,000/- at once. I said I cant pay this amount which I did not barrow from the bank. Then he said he will get discount if I paid at once and asked me to reply to his email.

He send me an email to settle the amount. A week later, he called my mobile number but I blocked him. Later, he send the threatening email to me and some the email he took from my Facebook friends.

Finally, I reply to the threatening email saying that I will complain or file a case against you for destroying my dignity by sending this kind of emails to all my Facebook contacts and I said that I am not going to pay this amount anyhow.

I asked about the credit shield I paid. He said that I should have informed the bank 3 month before my termination.

I asked why the bank did not contact me or last 7 years. He has no answer for that. I said that I will contact the bank and settle amount that I defaulted 7 years ago and I am not going to pay you or negotiate with any settlement.

Finally He said, the bank will not entertain me and they can not even wait as I wish and If I am not cooperate with them, they will deal with different perspective.

Please some one advice my how to deal this guy who threatening me and also damaging my dignity.

Is there any way to file a lawsuit against this collection agency for breaching my fundamental rights of dignity.

How I should deal with these people?

I wish to inform you that the statute of limitation in Sri Lanka is 3 years for money lent and 6 years for contract. The other party may not initiate a legal action against you for recovery of funds in Sri Lanka once the statute of limitation is past. You may file a complaint against the other party for harassment and oppression with the police. Alternatively, you may seek guidance from an attorney.

The more you get into conversation with them, the worse they will behave as it proves them that any of their actions affects you. Do not be in any conversation with them, no replies to any email, no answering of their calls, make all your social profiles more private and if they tend to turn up at your residence then call the police right in front of them as legally they cannot claim the amount from you in Sri Lanka.

In this regard they could not file a case against you in your home country for the unpaid debt in Saudi Arabia. Further, the collection agency is trying to collect the maximum they can by threatening you, actually they have no legal standing for collecting an amount what you does not owes to the bank. You can simply ignore their call.

Abu Dhabi launches 'one-day judicial system' for
minor cases


A new one-day court initiative launched in Abu Dhabi on Sunday to speed up the judicial process and ensure straightforward cases are dealt with as quickly as possible.
The one-day court began as a pilot last April and has already ruled on 2,443 criminal and misdemeanor cases, 65 labour cases and 205 civil and personal disputes.
A specialised judge in each Abu Dhabi court will now receive one-day court cases allocated by the public prosecution. In Al Ain and the Western Region, all judges are able to rule on cases that have been classified as one-day court material during regular hearings.
Eligible cases range from tourist offences to cross dressing, fights and civil disputes to traffic offences. It was also cover inheritance, delivering a child to his or her custodian, lifting a travel ban, municipality offences, immigration violations, bounced cheques and illegal alcohol consumption and possession.
Head of judicial inspection at the Abu Dhabi Judicial Department, Ali Al Shaer, said the trial period allowed the department to test the efficiency of the project and refine the rules.

A major challenge, he said, was with civil cases because they cannot be processed until the other side has been served, or notified.
"Once he or she is served, even if they don't attend we can proceed with the case. But if they have not been served, the ruling would be invalid."
Mohammed Al Shibli, head of the prosecutions department at ADJD, said it is essential that the judicial process for certain types of cases is sped up and hence that they are referred to the one-day court.
An important example, he said, is for cases involving tourists: "The tourist stays in the country for a limited period of time, and therefore it is important to resolve their cases quickly."
The new one-day court also aims to reduce the effort and money spent on imprisoning defendants in straightforward cases – cases where all the necessary factors, evidence and details are ready to be presented and that don't require further investigations or expert reports.
"Imprisoning defendants in such cases for a long time [while they await trial] is an unnecessary financial and security burden," Mr Al Shibli said.

ADJD, said labour courts heard 9,828 minor cases – claims for amounts that are less than Dh500,000 – last year. This year, he expects between 2,000 and 3,000 of them to be heard at the one-day court.
The ADJD initiative follows a similar move by RAK courts last February, which introduced the country’s first one-day courts handling civil and commercial cases that involve claims of up to Dh20,000.
Dubai courts followed a month later by introducing the one-day misdemeanor court, with one judge settling 6,000 cases in just over seven weeks.
Mr Al Shibli said Abu Dhabi's initiative is, however, more inclusive because it is in the form of a “one-day judicial system” and is not limited to specific courts or cases.
