Default Maharashtra Rent Control Act

Need your views, Trust duly registered under the Provision of the Societies Registration Act and Bombay Public Trust Act with the Office of the Registrar of Society and with the Office of the Charity Commissioner for the State of Maharashtra.

Trust are the Owner and the Landlords of the Property, situated at Andheri Mumbai Maharashtra

Is there any provision under Maharashtra Rent Control Act, 1999, which authorised the Owner, Landlord to charge delayed Payment @ of 18% per annum for the rent due for month under the Act.?

Does Maharashtra Rent Control Act, authorised the Owner , Landlord to charge Property Tax in Monthly Rent bill, for house whose carpet area is less than 500 sq.ft

Does Maharashtra Rent Control Act, authorised the Owner , Landlord to mentioned Maintenance Fees instead of Rent in the bill?

I wish to inform you that it is your rent agreement which will have jurisdiction in this matter. The Maharashtra Rent Control Act, 1999 defines standard rent, lays down the procedure for fixing standard rent and the per year increase in standard rent. You may contact a local attorney and seek guidance in this matter.

In this regard you should check your agreement to see if the terms mention anything about delayed payment and maintenance fee instead of rent. If the document specifically states that you are about to remit maintenance fee instead of rent the deal does not come under the purview of rent control act. It is good to check with a lawyer nearby you seek the legality of your rent agreement.
