Default Custody agreement required as part of court divorce?

TX

Legally or as a practical matter, does every divorce have to have a custody agreement included as well if there are two kids age 4 and 6? I don't want to have some rigid schedule and continuing court involvement.

Or can the two divorcing people just work it out themselves say week to week and have no agreement with the court?

Any advice on this?

It's not mandatory that a decree have a custody/visitation agreement. As a practical matter it should have one even if it's basic and allows for flexibility by mutual agreement.

You're very naive if you think that two divorced people with children will ever work anything out by themselves.

I wish to inform you that if you can come to a custody/visitation agreement with the other parent, you may file the custody/visitation agreement by mutual consent for approval of the court. Once the agreement is approved by the court, it will come into force. You may contact an attorney and seek further guidance in the matter, if needed.

In Texas, a divorce that involves children requires that there be an order for manager conservatorship (custody and visitation).

You can certainly come up with plans that work for your family.

I’ve never seen one that vague signed by a judge.
