Default Ex husband used my credit card without any permission to do so

My ex husband used my credit card last week for 43 dollar charge, thinking I am sure that I would never notice.
The card was one of two issued to me and both were apparently still activated--my new one has a chip.

Is this reason to file criminal charges ? Can I get his custody and visitation rights canceled!

You can report it to the police but I doubt it will ever go further than the report. Though you might need the report to get the charge reversed by your credit card company.

You have notified your credit card company of the fraudulent charge, right?

And had new cards with new numbers issued so he can't do it again?

Wow, really? You’d have your kid(s) have no father over $43?

You should know it’s you they’ll hate, they’ll be over 18 a long time.

This is not a sufficient reason to cancel custody and visitation rights.

Report the fraud to local police and dispute it with your credit card company. The only thing held against might be the outcome. You are innocent until proven guilty.

We need to know what state. In NY it's a felony because a credit card is involved. I would think that the same hold true in at least some other states as well.

We don't know anything about the father at this point except that he committed a crime.
